An EPC report provides energy efficiency and environmental impact ratings. It also estimates lighting, carbon dioxide emissions, energy use, and heating annually with the potential costs for each. The requirement to have an EPC has been the law since 2008 so if you’re asking do I need an EPC it may be the property already has one. Although bear in mind once completed the EPC is only valid for 10 years. Commercial property experts are on hand to deal with any questions you might have about MEES and the upcoming changes. They can review your existing leases to work out whether improvements can be made (or which party would be responsible for the costs of these). The MEES regulations prohibit landlords from granting any new leases of buildings with an energy efficiency rating as shown on an EPC of below an E so called 'sub-standard' properties unless the transaction is excepted from the regulations or an exemption applies and that exemption has been registered. The prohibition on granting leases of sub-standard properties also applies to renewal leases and extensions of existing tenancies. It is a legal requirement under the EU Directive on the Energy Performance of Buildings (EPBD) to make an EPC available whenever a building is being constructed, rented or sold. The main aim of the EPC is to bring about market differentiation on the basis of energy performance. Under the MEES and EPC regulations, it is perfectly possible to have a commercial building let before April 2018 on a long lease that continues past April 2023, with an EPC of F or G and not need to do any energy efficiency upgrading works under the regulations, as long as the EPC expires BEFORE 1 April 2023. However, at the time when the building is sold or re-let, then a new EPC will be required and MEES will apply to the new letting or existing letting post April 2023. Not sure where your EPC is? From 1st April 2018, any properties rented out in the private rented sector will need to have an EPC rating of at least ‘E’ – properties rated as ‘F’ and ‘G’ cannot lawfully be let out after this date. In the first instance, these changes will apply to new lets and tenancy renewals only. However, they will apply to all tenancies, new and existing, from 1st April 2020 onwards. The Minimum Energy Efficiency Standard (MEES) which came into force in England and Wales on 1 April 2018, applies to private rented residential and non-domestic property and is aimed at encouraging landlords and property owners to improve the energy efficiency of their properties by a restriction on the granting and continuation of existing tenancies where the property has an Energy Performance Certificate Rating of F and G. For homeowners, an EPC is required at the point of advertising a property for sale. The Domestic EPC is valid for ten years and can be used for multiple transactions. There is no pass or fail and no minimum standard that must be reached to sell a domestic property. In most circumstances, the landlord and their agent must ensure that an energy performance certificate (EPC) has been commissioned for a building before it is put on the market for rent. All reasonable efforts must be used to secure that the EPC is actually obtained within seven days of the building being put on the market and if this is not possible, it must be obtained within the following 21 days. There are some very specific cases where homeowners do not need an EPC. For instance, if your property is listed or in a conservation area, some improvements could alter the appearance of the property and this is generally deemed unacceptable. You don’t need one if your home isn’t for sale, either. It’s likely that you received a copy when you bought the house, however it doesn’t need to be renewed and the property doesn’t need to be reassessed until you decide to sell. There are many options available when it comes to commercial epc in today’s market.

You only need to renew an expired EPC when you plan to market the property for new tenants, when you make changes to the tenancy agreement with existing tenants, or if you want to reflect improvements you’ve made to a property that will result in an improved rating. Energy efficient purchases should not be viewed as an expense, but as an investment with utility savings that add up over the service life of the product. Savings can offset the initial price premium on energy efficient options, and offer a significant return in comparison to conventional, non-efficient alternatives. Furthermore, the return you pocket through savings will only increase over time as energy prices continue to rise. To date, the EPC rating for a property has served as a useful indicator of environmental efficiency. However, come the introduction of MEES in April 2018 the EPC rating for a property will take on additional and increased significance: If you receive an EPC and your property gets a low energy efficiency score, do not worry. The assessor will have added recommendations to the EPC report and it is up to you whether or not you wish to make these improvements yourself or leave it for the potential buyer to do once acquired. These suggestions should only be accepted as recommendations, there is no legal right in having to make these energy upgrades, it is at the seller/buyer discretion. The European Union introduced the Energy Performance of Buildings Directive (EPBD) in 2003. The UK Government followed with the Energy Performance of Buildings (Certificates and Inspections) Regulation in 2007. Commercial buildings contribute 20% of the UK’s carbon footprint. EPCs are part of a series of legislation to dramatically improve the energy efficiency of the UK’s commercial building stock, both new and existing. Even if you are not selling, it can still be helpful to obtain an EPC for your property. You can use the information to make your home more environmentally friendly and cut your fuel bills. The processes involved in undertaking a commercial EPC are fundamentally the same a domestic EPC, however a major difference is that the building needs to be divided into different ‘zones’ dependant on the activities conducted in the zones (ie office space, kitchen, storage area etc). Choosing the right commercial EPC provider can be a daunting task. That's why it's important to register an exemption with the relevant authorities first. Make sure you meet all the requirements before registering, including having an active EPC plan and proof of insurance. Once you've registered your exemption, the provider can start working with you to develop a proposal that meets your specific needs. It's important to choose a provider that is qualified and experienced in commercial EPC – this will ensure success for your business. There are also a range of Government schemes which offer loans, grants, or subsidised energy-saving measures to support small businesses. Recent examples include the Low Carbon Workspaces scheme which provided grants of up to £5,000 to small businesses to implement energy efficiency measures, or the Business Energy Efficiency Programme which offered similar grants of up to £20,000 In Northern Ireland, EPCs are a requirement for anyone selling or renting a property – with a fine of £200 for landlords without one. But there is no set minimum standard to be met. When choosing a commercial EPC provider, make sure to assess their experience in property improvement.
